One interseting thing you mentioned about your current employer "which is paying me half of what I should be earning as a GC holder".
Not paying the prevailing wage that the employer promised in the GC application....I don't know if you can use that to move and show that you wanted to work but the employer was not paying the prevailing wage and you had no option but to leave? I am sure that this is illegal on part of the employer...make sure you keep your paystubs to show this. But consult an attorney to see what he/she thinks.

You apply for H1 transfer before you join new company. Once u get the H1 receipt (2 weeks) then u can be in their payroll. Then file for AC21. If all goes well this is my plan in June 08.
My question is my wife has her EAD expiring 10/10/2008, AP on 11/19/08. She wants to travel to india in May and return in november. is it ok if I change employer while she is in india, my concern is when she comes back in november her EAD is expired, will it affect our 485 status?

I was hired for a position that required Masters and I fortunately was in EB2, but a colleague of mine, who is doing the similar work, was put in EB3 because his manager created the position with a requirement of Bachelors. He had a Master's degree. Here employee suffered because of his manager's ignorance
Wouldn't say it is ignorance on the part of the manager. Ignorance is easily abated by the employee talking to the manager. Plus any good lawyer will ask the manager if a master's degree is required for the job before proceeding with recruitment.
More often there are other reasons such as ego issues ("I don't have a college degree so why does my report need a master's degree") or practical difficulties (necessity to raise the wage offered) that can cause an otherwise qualified person to be classified as EB3.

Immigration in United States is a soveriegn issue of this country and foriegn governments cannot do anything about it. In fact, it would be offensive for Indian Govt to advice US congress to do something regarding immigration.
Kamalnath, India's commerce minister tried to meddle in British Parliament when they changed visa rules for Indian Doctors. The British Parliament warned him and asked him to BACK OFF.
Immigration is not a trade issue. There is not deal between 2 nations on immigration. We are not talking about crude oil or soybeans trading.
Please end this discussion here. It looks really naive of us to even think like this.

RFE and NOID come with a color sheet of paper with your details and some USCIS internal codes for your case. You can respond by yourself and put the sheet on top - this is for the mailroom to handle your case

Here is the short version of how it unfolded. I've seen some quick responses from USCIS.
9/15/2010 - USCIS email indicating that cards mailed for both me and spouse
9/16/2010 - Spouse received card
9/21/2010 - Got email (LUD) that my card returned undelivered.
9/22/2010 - Called customer service updated the address
9/23/2010 - Got my card in mail (wrapped in an usps priority envelope) with tracking number
I was pleasantly surprised with the fastness of USCIS.

I don't want to discourage you, but IV has looked into all these options earlier and has realized that it would be fruitless to try and ask our lazy politicians to take up our case with the US govt. More over this is an internal matter of US govt and Indian government cannot influence their policies and laws. Why would you expect Indian govt. to fight for you, when you left the Indian shores and want to settle down in US for your comfort?
Having said that, if you do have contacts and would like to take the lead in reaching out to the Indian govt, IV will support you. So please do the honors.
Its not an internal matter anymore. We live in a global economy. If Mexican govt. can do it for there unskilled workforce. I guess we have a better case. Dont mind you sound to me like do it alone dude. Most of us have waited years of agony and waiting. Indian govt like any other govt will do it for there interests. Remember all the $$s that pour into our RBI reserve. If you thought that was because of Indians and had nothing to do with NRIs..think again!
Its always about the same thing. US gets competitive having us on there side and India continues to enjoy the NRI effect. Its mutual.

If I'm not mistaken, the 485 processing times for TSC are much shorter compared to NSC. My case is at the VSC which is still doing 06 applications. Is there a particular reason behind this or is it just the sheer number of applications that VSC receives?

it dont just sound like you have dust on your sensor. you do have dust on your sensor. at this point you have 3 options. you can do what nikon and canon recomend and blow the dust out with a blower bulb at wich point your head may explode from the frustration of NOT getting the dust of since it clings to it through static charge. the next and most stress free way to do it is to find a local camera shop that will clean it for you (not all will do this for you however). the service is available here in okc for 85 smakaronies. The should use a stero scope to get down there and get every piece of dust off so that your sensor will be back to the original shape absolutely no dust. or you can be brave and make a small investment on ecipse cleaning solution and cleaning swabbs. the solution is streakless after it dries. also get a special set of cleaning brushes that you can swipe across the sensor without scratching the sensor. as i said the method i recomend is paying the mola to have someone else do it as when i tried to clean my sensor i was so nervouse i just did not trust myself to do a good job.

I think you can still work without the SSN, on valid employment authorization (H1B, EAD, etc.). You cannot get paid until you get SSN.
Check with Social security office. Should not take much time...
