    I am on the same boat...my wife got H1 approval recently without COS, and H4 extension applied two weeks ago (on top of it I-485 has been applied).

    My lawyer suggested to file for H4 extension to cover that gap that is there before H1-B takes effect i.e. October 1st (or she will be Out Of Status). And after October 1st, revoke the H4 petition.

    Hi All,
    My previous I-140 was denied due to the ability to pay issue since company was in loss and Idid not get prevailing wage since PD.I have appealed it hoping I can extend my h1 beyond 6th year.Is it true?

    Also, Now we have pre approved labor with lower in same company where I can satisfy by showing W-2 to prove the ability to pay. Now If I am planning to apply another I-140 with labor sub,

    would it matter to the new I-140 appllication if the previous I-140 was denied and is being currently appealed? Because in the I-140 form there is a question ,
    "Has any Immigrant visa petition been filed by or on this person?"
    Should I say "YES", Right? and also give the detail of previous filing????

    Also How does USCIS verify the W2?BY contacting the IRS or ?
    Please suggest?

    You have to give them detailed information.if you don't still they pull up your records.

    IRS database can be accessed by USCIS under homeland security rule to verify any information regarding an individual.

    Hello,

    My spouse will be in India next week and would be going for her H1B stamping at the Mumbai consulate. She came here on H4 and we applied for her H1B, effective 10/2007, and she has been working since Jan08 and have all her paystubs from that date. Can you share your experience in terms of questions they ask and supporting documents they request in addition to the documents that we are required to carry.

    Mainly they ask for W2 , tax returns for all years, she was on h1. And you can also send your tax returns for all the other years she was on h4.

    Thanks for sharing the info.

    Was it first h1 renewal (meaning 3rd year) or second h1 renewal (meaning 7th year).

    Did you do anything extra to avoid PIMS delay (like when you renewed your h1) did your employer keep another copy with a notice saying send to Kentucky CC

    How long was the gap between h1 renewal received and you going for stamping?

    It was first H1b ext. Company did not send second copy to Kentucky CC . On roadside window where VFS does preliminary check , vfs person put PIMS forbid in DS 156. Dont know what does it mean. also h1b renewal was in nov 2008 and I went for .stamping in feb 2009.

    One more thing VFS mumbai told me that they will not allow even US born child ( even new born ) if they are not applicant. Only applicant child ( those who are for h4 ) allowed inside. at delhi situation was totally different.

    That e-verify thing sounds reasonable, but it is dangerous. The way things work, and as we are seeing now, things like that get expanded and they grow ever more intrusive. Pretty soon people will need government permission even to breathe. In fact, the EPA now claims the right to regulate carbon dioxide, that thing we breathe out...

    I think it is time we started our own chapter in NE and get the action going. Members from Nebraska, please respond.

    Yes that's the spirit. Starting off is difficult but you only need a few dedicated members to get the ball rolling, and motivate others. We have members in different parts of NC, and we are able to get a lot of things done on the phone or internet.

    You can start by creating a google or yahoo group, and verify member information (name, contact info and such) as you sign them up.

    I got my GC but my wife's application (based on my 485) is still pending. I think at this point I can switch jobs/go to school full time and it won't affect my spouse's case. Just want to double check on this, any thoughts??

    I was moved from state (A) to another state (B) along with Client 'Y' four years back...and my Employer didn't filed for H1 amendment at that time, but my payroll was running from State B with same salary. I was not aware of this rule to file an amendment for change in job location and I dont know even employer is aware of that or not.

    After three years I got EAD and I Employed by Company X in state B.

    My question is....what are my options and problems for not being filed H1 Amendment four years back.?

    Please advice.

    I once fell out of status because I failed to maintained 12 units. I filed for reinstatement and it was approved after 2 miserable years. I had no idea why it took them that long but in those 2 years I felt my life was put on hold. Good news, yes they do approve if you file however you have to have a good reason in your letter to convince them to reinstate you. Goodluck

    I got laid off recently.

    Now got job with 2 companies. 1 small and 1 big. 3 questions:
    (1) Should I select based on my salary? Big company offers more salary.
    (2) I have to now start Greencard again. So should I choose big company or small ? Both said they will consider sponsoring if performance is good.
    (3) If I transfer H1B Is Big company likely to get RFE or small?

    Hello,

    I need to know if it is safe to travel to India on AP and EAD documents without having a valid H4 visa. My H4 visa had been renewed once and now after 3 years it has expired on Dec 12 2010. I need to go to India to see my father who is very ill. I want to know if re-entry into the US will be a problem on my AP and EAD. Also, will it effect the entry of my daughter (if she travels with me) who is 2.5 years old and is US citizen.

    please help!!

    My wife travelled to Pakistan last year when we had a new born baby !!! she first came to USA on h4 visa but when she left her h4 was already expired so when she returned to usa after 3months she used AP and had no problems.....she says the immigration officer didnt even look at her expired h4 and jst stamped the AP without asking any questions....it was a smooth process !!!!! so don't worry and travel !!!!! hope ur dad feels better when he see u !!!!! goood luck !!!!

    Hi

    I got my GC approved for me and son (I485 application) in Nov 2007. I got my gc, whereas for my son who is 7 year old though he got I485 approved yet he did not get his GC. They mentioned they might need his finger print and so far no response from them. This is despite several follow up with them.

    Last year 7 months he was not in US and now can he go to India and he will be there rest of this year.

    Will it affect his GC and when will he get his GC?

    Hello Folks:

    This long wait for Green Card has made me think about a number of things...

    A few days back a couple of my friends have recieved notices from USCIS are sending notices 'Intent to Deny their I-485' w/o any rhyme or reason. Employer says they have not withdrawn their I-140. They said they will appeal but if nothing happens they will go back to India.

    Just worried...if this happens to me and I am forced to go out of the country in 30 days, what happens to my US loans. I do not think I would be able to repay back my home & car loans with an Indian salary if I return. In this market I can only sell at a huge loss. I also used US Line of credit for education purposes. Do I need to file bankruptcy? I am on a EAD right now...

    Any thoughts on this... greatly appreciate ....it

    This is teh first time I am coming across this "Denying without any reason" - If this is really happening then it is a very serious issue. Your friends can contact IV if there is such a notice

    Another substitute case...

    Any reason you went for substitute labor instead of your own?

    I applied for I-140 in July 2007 using a substitute labor EB2 (from a different company) with a priority date of Nov 2005 and it got approved in May 2008.

    During the same July fiasco, my employer at that time applied for I-485 with a priority date of August 2006.

    I didn't apply for priority date porting after the substitute labor I-140 got approved because I didn't have the approval notice.

    I read somewhere that even though I didn't apply for porting of the date, USCIS will consider the earlier date. How far is this true? How can I find out my correct priority date?
