    My I-485 is pending, was filed in July, 07. My PD is June, 04 (EB2 India). I-140 is approved. I have to leave the US for a year to work on an expat assignment beginning last week of December, 07. I have my EAD and AP. Also, I am on a valid H1-B until May, 2008 but will be applying for an extension until May, 2009.

    Please let me know your thoughts if it would be ok for me to leave the US for a continuous period of one year while my I-485 is pending? I plan to renter the US on H-1B and not EAD/AP.

    Also, does one need to be physically present in the US to renew EAD and AP? My EAD and AP will expire in September, 07 but will I be able to renew them when I am back in Jan,09?

    For the period I am gone, do I need to pay any taxes on my foreign-earned income if I am going to a jurisdiction with which India has a favorable tax treaty? If my I-485 is pending but I am not working in the US, I do not need to pay taxes for the income earned abroad if I do not meet the "substantial prsence test" (183 days)?

    Any thoughts will be much appreciated.

    Yes, Finger prints are done in Oct 07

    Make an infoPass appointment and go with the proof of travel emergency and your receipt notice. They might issue AP.

    I will first check CISOmbudsman's web site's FAQ and USCIS Faq for this. But i can not do it at this time.

    This was a GREAT week for all of us. Past three days have changed our discussion topics and we're now more concerned about doctor appointments and certificates.     IMO there is a good chance you will qualify for EB2. When doing educational evaluation, you should base your claim on your masters degree. That way you would qualify.

    The worst part is in justifying an EB2 case. As the job market is very bad and many US citizens with the required qualification for the position are available, it will be very difficult for the company to justify that no one in this country is available except you for this position. Lot of big companies are afraid as there is a strict AUDIT that will be enforeced by USCIS in case they have a doubt about the non availability of a citizen for that position.

    Helllo Experts,

    Here is my Case:

    Have 4 yrs of work experience and changed 3 employers in the past.

    1 st employer: Worked as a Programmer Analyst for 6 months
    2nd employer: Worked as Sr.Software Engineer for1.6 years
    3rd Employer: Worked as Sr.Software Engineer for 2 years

    Under unexpected circumstances, 2nd employer filed my H1 for a senior level even when I have only 2.5 yrs of experience.

    I am trying to change job and look for a prospective employer who would file my labor/GC immediately.

    The 4rth employer is willing to my GC but the Job designation will be Software Engineer.

    Can you please advise if there would be any negative impact on my GC process if I take a step down in my title.

    I liked the organization, work environment and all I am concerned now is about any RFC's for the different Job Titles I had so far.

    I am in a very confused state and Please advise me as I need to respond for the Job offer.

    I sincerely appreciate your help.

    Isnt the three year extension valid only if you cannot file your I-485 because of retrogression? Once you file your 485, you get only a year?

    1. Labor Pending for > 365 days = 1 year H1 extension
    2. 140 Approved AND 485 Filed & Pending AND Priority Dates Current = 1 year H1 extension
    3. 140 Approved AND Priority Dates NOT Current = 3 year H1 extension
    4. 140 Approved AND 485 Filed & Pending AND Priority Dates NOT Current = 3 year H1 extension

    My wife got her F1 stamped in Mexico last week and I just noticed that her old I 94 from the time when she entered in US with her H4 is still in her passport. Is that a problem?? I remember reading some where on the forum that they are supposed to take out I 94 for the departure record...
    How do I fix this?

    How easy is to obtain L-1A through immigration lawyers?

    HI,

    I received a 500$ check for apartment referral , I am planning to give the entire amount to the person who took the apartment. I was wondering if during the tax return filing I should be reporting this as an income and if yes should I be deducting the tax amount from the 500$ as I will be paying taxes on it.
